LRS exercises the highest standard of care to ensure that the terms of the trust are properly carried out while making the process as understandable and stress-free as possible. These fiduciary duties under the California Probate Code include providing notice to beneficiaries, gathering assets, obtaining appraisals, notifying potential creditors, filing tax returns, providing accountings to beneficiaries, distributing assets, along with other responsibilities.
LRS serves as the personal representative in Probate, which is a public court proceeding to transfer title from a decedent to his or her heirs. The California Probate Code requires personal representatives to provide various notices to all interested parties of the proceeding, to collect and inventory all the decedent’s assets, address creditors and applicable federal and state taxes, and distribute the assets to the estate’s beneficiaries.
Responsible for overseeing the management of personal care and/or finances for one who is deemed unable to do so by the court. Parameters of conservatorship are determined by court proceeding and implemented to the Conservator upon appointment.
